
Overview of Family Immigration Benefits
The United States offers family immigration benefits through two main categories: Immediate Relatives and the Preference System. Each category has distinct eligibility requirements and processes for sponsoring family members.
Immediate Relatives
Immediate relatives include spouses of U.S. citizens, unmarried minor children of U.S. citizens, and parents of U.S. citizens who are at least 21 years old. U.S. citizens can sponsor their spouse, minor children, and parents for immigration benefits. However, to sponsor a parent, the sponsoring U.S. citizen must be at least 21 years of age. One significant advantage of immigrating as an immediate relative is that there is no quota for the number of visas available in this category.
Preference System
Family immigration benefits are also available under the preference system, which operates based on a quota. This system allocates visas to the following family members:
- Sons and daughters (married or unmarried) of U.S. citizens
- Brothers and sisters of U.S. citizens who are at least 21 years old
- Spouses and unmarried children of Lawful Permanent Residents (LPRs)
- Sons and daughters of LPRs
It is important to note that Lawful Permanent Residents cannot sponsor their parents under the preference system.
How long does Family based Immigration take in 2025
- Immediate Relatives of U.S. Citizens
Processing time: Typically, 10 to 18 months on average. Some sources report slightly shorter times for spouses inside the U.S. (about 8-10 months for adjustment of status) and longer for consular processing abroad (up to 14.5 to 20 months).
- Spouses and Children of Green Card Holder (F2A)
- Processing time: 18-35 months due to demands and visa retrogression
- Adult Children and siblings of U. S. Citizens (F1, F3, F4)
- Processing time: 5-20+ years depending on category and country of origin.
Unmarried adult children – (F1) – 8-9 years
Married Children – (F3) – 14 years
Siblings – (F4) 18-24 years (Some countries like Mexico, India and the Philippines face longer waits due to high demands)
